Jeanne moved to approve the following resolutions: RESOLUTION NO. 2015 - 9 ESTABLISHING A PORTION OF COUNTY ROAD NO. 8 WHERE IT CURRENTLY EXISTS KNOWN AS THE BEARLODGE COUNTY ROAD WHEREAS, County Road No. 8 known as the Bearlodge County Road route has changed over the years and an agreement was entered into October 4, 2011 at Commissioners Proceedings Book 11 page 243 upon a petition to vacate portions of County Road 8 and 266 to commence proceedings to clarify the matter; and WHEREAS, a Map of Survey was prepared of the eastern portion of County Road No. 266 and south portion of County Road No. 8 where the county roads currently exists on the ground and was recorded at Instrument No. 625866 Rod No. 26 and Map No. 1506 in the Office of the County Clerk in the Crook County Courthouse, Sundance, Wyoming specifically describing the centerline and right-of-way easements for the portion of each County Road; and WHEREAS, the State of Wyoming granted a Perpetual Roadway Easement No. 440 for a portion County Road No. 8 to Crook County which was signed and recorded in the Crook County Clerk's Office in Sundance, Wyoming at Instrument No. 111489 at Book 90 at Page 89; and WHEREAS, the current private landowners have granted Right-of-Way Easements and Consent to the Establishment or Alteration of County Road No. 8 to Crook County which have been signed and recorded in the Crook County Clerk's Office in Sundance, Wyoming at Instrument No. 634299 at Photo Book 544 at Page 792, Instrument No. 634300 at Photo Book 544 at Page 795, Instrument No. 634301 at Photo Book 544 at Page 798, instrument No. 634302 at Photo Book 544 at Page 802, and a portion dedicated to the public for County Road No. 8 on August 3, 2009 shown at Instrument No. 604450 at File 477 Map 1455; and WHEREAS all of the easements for the County Road are sixty-six (66) feet wide, that is, thirty-three (33) feet on each side of the centerline of the route described in the legal descriptions and easements set forth above, and the private landowner easements also include a limited right-of-way upon the land fifty (50) feet from the endpoint of any culvert, cattleguard, bridge or underpass upon said road for the limited purpose of maintaining or replacing said item; and WHEREAS, the landowners entered into an agreement whereby they would grant Easements for the existing county road to the County and the County would vacate or alter the old unused portions of the County Road across their land in the area; and WHEREAS one landowner along the route did not grant the County an easement and consent to establishing County Road No. 8 where it currently existed across his property so the Board of County Commissioners had to establish that portion of the road by adverse possession by Resolution 2015-5 located in the County Clerks' Office at Instrument No. 636083 at Photo Book 548 at Page 450. WHEREAS, the Board of County Commissioners have the authority pursuant to Wyoming Statute 24-3-108 to establish a County Road when in their judgment such action shall be in the interest of the economy or the public good and the road is of sufficient importance to be opened and traveled; and WHEREAS, this county road affects the following described property, to wit: Townshin 51 North Ranae 63 West of the 6th P. WARREN'S PEAK COUNTY ROAD No. 100 recorded at Rod No. 14 and Map No.952-953 (Old Plat 124) SUNDANCE-WARREN PEAK COUNTY ROAD No. 208 recorded at Rod No. 10 and Map'No. 836-841 HUMPHREY COUNTY ROAD No. 223 recorded at Rod No.14 and Map No.953-954 recorded at Instrument No. 618251 Book 513 of Photos Page 758 WHEREAS Wyoming Statute 24-3-201, Et seq Identification of county roads allows for the vacation of County Roads that are not currently identified and maintained; and WHEREAS the Notice of Identification of County Roads together with a map identifying the coun~ roads was published for two (2) consecutive weeks in three (3) newspapers of general circulation within Crook County, the Sundance Times, Moorcroff Leader and Wyoming Pioneer on February 26, 2015 and March 5, 2015, and published on the Crook County website at WWw.crookcounfy.wy.gov from February 26, 2015; and WHEREAS Resolution No. 2015-6, the Notice of Identification of County Roads, and the map identifying the county roads, were mailed on February 23, 2015 by U.S. Mail postage prepaid to all of the landowners located in Sections 4, 5, 6, 7, 8, 9, and 16 all in Township 51 North, Range 63 West of the 6th P.M.; and WHEREAS no objections or claims for damages were filed with the Crook County Clerk by noon on April 3, 2015 as required by the Notice of Identification of County Roads; and WHEREAS a portion of the BEARLoDGE COUNTY ROAD No. 8 was established by consent in Resolution 2015-9 and by Adverse Possession in Resolution No.2015-5; and WHEREAS a portion of the MILLER CREEK COUNTY ROAD No. 266 was established by consent in Resolution 2015-I0 and by Adverse Possession in Resolution No. 2015-4. THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS IN AND FOR CROOK COUNTY, WYOMING, that those portions of the county roads located in Sections 4, 5, 6, 7, 8, 9, and 16 all in Township 51 North, Range 63 West of the 6th P.M that are generally located northwest of Sundance, Wyoming not set forth above and shown on the Map identifying the county roads are hereby vacated pursuant to the identification procedure contained in W.S. 24-3-201 through 24-3-206, and the roads identified as referred to above and shown on the Map as county roads are declared, altered and established as county roads.
